These Terms and Conditions govern your use of DriveForce Media’s software-as-a-service (“SaaS”) platform and related services, which provide marketing solutions tailored for car dealerships. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services. DriveForce Media is a marketing agency that provides Clients with:

Access to a software-as-a-service (SaaS) platform customized and branded for their dealership. Tools for marketing automation and customer relationship management (CRM). Technical support and onboarding assistance to maximize platform effectiveness.

Clients are responsible for:

Providing accurate and up-to-date information for account setup. Complying with all applicable laws, including data protection and advertising regulations. Avoiding prohibited activities such as reverse engineering the platform or sharing credentials with unauthorized parties.

Payment terms include:

Subscription fees as outlined in agreements, with late payments subject to interest. No refunds for unused portions of prepaid fees unless required by law.

Intellectual property rights:

DriveForce Media retains ownership of the platform, including any enhancements or modifications. Clients are granted a non-exclusive, non-transferable license to use the platform during the subscription term.

Termination provisions:

Either party may terminate the agreement under specified conditions. Upon termination, Clients lose access to the Services, and associated data may be deleted.

Additional terms:

Confidentiality obligations apply to both parties, with exceptions for public or independently developed data. The Services are provided “AS IS” without warranties, and liability is limited to fees paid in the prior 12 months. Clients indemnify DriveForce Media against claims arising from use of the Services.

Data privacy and usage:

Data is processed and stored per our Privacy Policy. Third-party integrations may be utilized to deliver Services effectively.

Governing law and amendments:

These Terms are governed by South Carolina law, with disputes resolved via arbitration in Berkleley County. DriveForce Media reserves the right to amend these Terms with notice.
